The Site constitutes a work of authorship protected by the French Intellectual Property Code and by the applicable international regulations. The User may not in any way reuse, assign or exploit for their own account all or part of the elements or works of the Site, except in the cases provided for in Article 5.

Use of the Site implies full and unreserved acceptance of these general terms of use (the “Terms of Use”). They may be amended or supplemented at any time; the applicable version is the one online on the date of consultation. The date of the last update appears at the bottom of this page.

The Site is normally accessible at all times. The Publisher may, however, suspend access to it for technical maintenance and endeavours to inform users in advance, without this giving rise to any compensation.

The User undertakes to use the Site in accordance with the law and these Terms of Use, and not to disrupt its operation (intrusion, mass or automated extraction of content, sending of unlawful or abusive messages).

The Site is offered in several languages. In the event of any discrepancy between the versions, the French version shall prevail.

3. Description of the services provided, quotations and bookings.

The purpose of the Site is to present Le Papayer Ecolodge in Cap Skirring (Casamance, Senegal), its accommodation and the activities offered. The Publisher endeavours to provide information that is as accurate as possible, but cannot be held liable for omissions, inaccuracies or delays in updating, whether attributable to the Publisher or to third-party partners who provide it with such information.

The Site makes it possible to submit a request for a quotation or a booking. Such a request is binding on neither the Guest nor the Publisher. Pursuant to Article L.221-28 12° of the French Consumer Code (Code de la consommation), the right of withdrawal does not apply to accommodation and leisure services provided on a specific date or within a specific period.

Any request for a quotation or a booking, and any stay, constitutes acceptance of these Terms of Use, in particular of Article 7 on liability and safety. The Guest undertakes to bring these Terms of Use to the attention of the persons accompanying them (family, friends, group) and is responsible for their compliance.

4. Contractual limitations relating to technical data.

The Site uses JavaScript technology. The User undertakes to access it using recent, virus-free equipment and an up-to-date browser. The Publisher cannot be held liable for any material damage linked to the use of the Site.

The Site is hosted by a provider located in the European Union. The hosting provider in principle ensures the continuity of its service; it nevertheless reserves the right to interrupt it for as short a time as possible, in particular for maintenance, improvement or failure of its infrastructure, or in the event of traffic deemed abnormal.

The Publisher and the hosting provider cannot be held liable for any malfunction of the Internet network, telephone lines or computer or telephone equipment, in particular due to network congestion preventing access to the server.

5. Intellectual property and counterfeits.

www.lepapayer.com owns the property rights intellectual property and holds the rights of use on all the elements accessible on the website, in particular the texts, images, graphics, logos, videos, icons and sounds. Any reproduction, representation, modification, publication, adaptation of all or part of the elements of the site, whatever the means or process used, is prohibited without the prior written consent of: www.lepapayer.com.

Any unauthorized use of the site or any of the elements it contains will be considered as constituting an infringement and prosecuted in accordance with the provisions of Articles L.335-2 and following of the Intellectual Property Code.

5.1 Photographs and visual content

All photographs featured on the website https://www.lepapayer.com — in particular views of the establishment, the accommodation, the beach, the excursions and the landscapes of Casamance — are original works of which Le Papayer Ecolodge is the exclusive owner and copyright holder.

These photographs are protected under the applicable provisions of intellectual property and copyright law. Any reproduction, downloading, copying, capture, reuse, distribution, republication or exploitation, in whole or in part, on any medium and by any process whatsoever, including for the purposes of illustration, indexing or the training of automated systems, is strictly prohibited without the prior written authorization of Le Papayer Ecolodge.

Exception – Press area: the photographs made available in the Press & Partnerships area may be used free of charge for online editorial use, with the credit “© Le Papayer Ecolodge” and a link, under the licence terms stated on that page. Print and magazine (paper press) use is invoiced as author's rights, on prior quote; any retouching, montage or commercial use requires prior written agreement.

The photographs may be offered under an exclusive commercial licence. Any natural or legal person wishing to acquire a right of use over one of these images must submit a prior request to Le Papayer Ecolodge via the Contact page.

Any unauthorized use of one or more photographs will be subject to legal proceedings in accordance with the applicable provisions of intellectual property law.

6. Limitations of liability relating to the Site.

The Publisher acts as publisher of the Site and endeavours to keep its content accurate and up to date.

The Publisher cannot be held liable for damage caused to the User's equipment when accessing the Site and resulting from the use of equipment that does not meet the specifications set out in Article 4, or from the occurrence of a bug or an incompatibility, nor for any indirect damage (for example, loss of business or loss of opportunity) resulting from the use of the Site.

Interactive areas (contact form, quotation request) are made available to users. The Publisher reserves the right to delete, without prior formal notice, any content that contravenes the applicable legislation, in particular the provisions relating to data protection. It may also bring civil and/or criminal proceedings against the User, in particular in the event of a message of a racist, insulting, defamatory or pornographic nature, whatever the medium (text, photograph, etc.).

The limitations in this article apply to the extent permitted by law; they do not concern the Publisher's liability for stays and activities, which is dealt with in Article 7.

7. Civil liability, safety of stays and activities.

Safety preface. Le Papayer Ecolodge is located in Africa, in a tropical zone, on the shore of the Atlantic Ocean: the climate, nature, wildlife, health conditions, infrastructure and emergency and medical services, which may be distant or limited, are not those of a stay in Europe. Guests must therefore adapt their habits to this context. They are required to follow the recommendations and instructions of the Publisher and its staff, which are intended to prevent any problem, and to behave prudently in all circumstances.

Le Papayer Ecolodge is located on the seafront, in a natural environment (wooded garden, beach, ocean, local fauna and flora) where certain risks cannot be entirely eliminated. Stays and activities are undertaken under the responsibility of each Guest, of the persons accompanying them and of their children, and under the cover of their own insurance. This article sets out the role and responsibility of each party. It applies to Guests and to any person staying at the establishment or taking part in an activity.

7.1 Principle of liability.

Each Guest and each person accompanying them stays under their own responsibility. They remain responsible for their own conduct and safety and for that of the persons in their care (in particular their children), as well as for any damage they cause to others or to the facilities or equipment of the Publisher or its providers. Their personal civil liability is engaged in this respect, and it is their own insurance (personal civil liability cover or equivalent) that must respond in the first instance.

The Publisher is bound by an obligation of means (obligation de moyens) as regards the safety of the Services it provides itself. It cannot be held liable for accidents or damage resulting from the conduct or carelessness of a Guest or the persons accompanying them, from failure to comply with safety instructions, from the act of a third party, from natural events, from an event of force majeure or, more generally, from causes external to the Publisher. Fault on the part of the victim or of a third party exonerates the Publisher, wholly or partly, to the extent permitted by law.

The Publisher is liable, under the conditions of the applicable law, solely for damage resulting from its own proven fault, in particular with regard to the condition and maintenance of the accommodation and facilities it makes available. Nothing in these Terms of Use limits or excludes its liability for death or personal injury caused by its fault, for fraud (dol) or gross negligence (faute lourde), nor the mandatory rights granted to consumers by law.

7.2 Stay, beach and swimming.
  • Guests are required to comply with the safety instructions and house rules communicated on arrival, in writing or on site.
  • Making fires on the grounds of Le Papayer Ecolodge is strictly prohibited, owing to the risk of fire.
  • Smoking is prohibited inside the premises (accommodation and covered common areas).
  • Any damage, fire or accident resulting from a failure to comply with these prohibitions shall engage the liability of the Guest, who is responsible for their companions. Failure to comply with these prohibitions may result in the stay being terminated under the conditions set out in article 7.8.
  • Children and vulnerable persons must, without exception, be accompanied by their parents or a responsible adult when going to the seafront, and must remain under their constant and direct supervision throughout the entire time spent bathing or on the beach. Children must never go to the water's edge alone. In the garden and on the facilities, they likewise remain under the supervision of their parents.
  • The Publisher provides neither safety nor supervision of bathing: no lifeguard or monitoring system is organised. The sea is the Atlantic Ocean (currents, tides, swell, waves, variable seabed) and it may be dangerous to venture beyond one's depth, even for a good swimmer. It is recommended to bathe only where one can touch the bottom. Bathing and beach activities are undertaken at each person's own risk and under their sole responsibility and, in the case of minors, that of their parents or accompanying adults.
  • Venturing into the parts of the grounds of Le Papayer Ecolodge that have not been cleaned and cleared is strongly discouraged; guests are advised to stay on the paths and in the maintained areas. Venturing into tall grass, where it is not possible to see clearly where one is stepping, can be extremely dangerous.
  • The presence of snakes may expose anyone venturing into these areas to bites that can be fatal. The Publisher does not keep antivenom serum on site. Any exploration of these areas is undertaken at the sole risk and under the sole responsibility of the person concerned. In the event of a bite or injury, the Publisher must be informed immediately and a doctor must be consulted without delay.
  • Children must always be accompanied by a parent or a responsible adult when exploring the grounds of Le Papayer Ecolodge.
  • It is the responsibility of each person to find out about the health and climatic conditions of the stay (vaccinations, malaria prevention, sun exposure, hydration) and to consult a doctor before departure if necessary.
  • It is recommended not to leave valuables unattended. The Publisher disclaims all liability in this respect within the limits permitted by law.
7.3 Excursions by 4x4 vehicle.

Excursions made by 4x4 vehicle are covered by the insurance of the vehicle used. Participants undertake to follow the driver's instructions, in particular to wear a seat belt, and acknowledge that the condition of roads and tracks in Casamance may vary.

7.4 Pirogue, fishing and water activities.

Pirogue outings, fishing and excursions at sea or on the rivers and bolongs are provided by independent boatmen and guides, who pilot the boat, supply the equipment and are solely responsible for navigation, safety on board, their equipment and their own insurance. In this context, the Publisher acts solely to provide information and to put parties in contact. The Guest contracts directly with these providers for these activities.

From the moment of boarding, the Publisher's liability is no longer engaged for matters relating to navigation and the conduct of the outing, save where fault on its part is proven, and within the limits of the law (Article 7.1).

Before boarding, each participant must ensure that a suitable life jacket is available, inform the boatman of any health or swimming difficulty, and follow the boatman's instructions. It is recommended that participants be able to swim.

Other water activities (in particular kitesurfing) are practised under the sole responsibility of the participants and, where applicable, of the independent schools or providers, who must ensure that the participants' level, the condition of the equipment and their insurance are appropriate.

7.5 Insurance, assistance and repatriation.

The Publisher strongly recommends that each Guest take out, before departure, travel insurance covering at least assistance and medical repatriation, medical and hospitalisation expenses, evacuation, personal civil liability, personal accident and, if necessary, cancellation.

In the absence of such insurance, medical, evacuation, repatriation or extended-stay expenses shall be borne by the Guest and the persons accompanying them. The Guest declares that they were informed of this recommendation before their stay and takes out their insurance under their sole responsibility.

Excursions by 4x4 vehicle are covered by the vehicle's insurance (Article 7.3) and pirogue outings by the boatman's insurance (Article 7.4).

7.6 Force majeure and external conditions.

The Publisher and the providers are not liable for the non-performance, delay or modification of a Service due to force majeure or to external events (weather or sea conditions, tides, condition of tracks, security, power, network or transport outages). An excursion may be cancelled or modified for safety reasons.

7.7 Fitness, health and participation of minors.

Each participant declares that they are physically fit for the activities in which they take part and undertakes to report, before the activity, any health problem or contraindication (for example pregnancy, heart or respiratory disease, difficulty swimming). Minors take part in activities under the responsibility of their parents or accompanying adults, who authorise their participation.

Persons who are ill, disabled or have reduced mobility, or who have particular medical needs, and who choose to stay at Le Papayer Ecolodge do so in full knowledge of the facts, having taken note of the conditions of the site (natural environment, terrain, possible distance from emergency services), and accordingly accept the risks inherent in their stay, without prejudice to Article 7.1. They are advised, but not obliged, to inform the Publisher before their arrival so that the possible adaptations can be considered together, to consult their doctor and to arrange the necessary treatment and assistance.

7.8 Conduct and local laws.

Guests shall comply with the laws and customs of Senegal. The Publisher may refuse or interrupt an activity, or terminate the stay without refund, where a Guest's conduct (intoxication, use of illegal substances, endangerment, repeated failure to comply with instructions, disturbances) jeopardises their own safety, that of others or the peace and quiet of the premises, to the extent permitted by law.

7.9 Reporting of incidents.

Any incident, accident or damage must be reported to the Publisher on site and without delay, so that assistance can be provided, a report drawn up and evidence gathered (photographs, witness statements). Failing this, the Guest shall notify it in writing to opapayer@gmail.com as soon as possible. Late reporting may make it more difficult to establish the facts.

7.10 Cap on liability.

Except in the case of personal injury, gross negligence (faute lourde) or fraud (dol), and subject to the applicable mandatory rules, the Publisher's liability, for all causes combined, for material and non-material damage is limited to the amount paid by the Guest for the Service concerned. Indirect damage (loss of opportunity, loss of business, loss of income) is not compensated. With regard to consumers, this limitation applies only to the extent permitted by law.

8. Management of personal data.

The Publisher processes personal data in compliance with the GDPR, amended French Law no. 78-17 of 6 January 1978 (the “Informatique et Libertés” Act) and Law no. 2004-575 of 21 June 2004.

8.1 Controller.

The controller is the association Humanitarian Techno Pôle (contact details in Article 1), represented by its president. Contact: opapayer@gmail.com.

8.2 Data collected, purposes and legal bases.
  • 🔹 Quotation, booking or contact requests (surname, first name, e-mail address, telephone, dates of stay, number of travellers, message): responding to the request, drawing up the quotation, managing the booking and the stay. Legal basis: pre-contractual measures or performance of the contract (Art. 6(1)(b) GDPR).
  • 🔹 Guest relationship management and accounting obligations: invoicing, retention of records. Legal basis: legal obligation (Art. 6(1)(c)).
  • 🔹 Security of the Site and prevention of fraud and spam (IP address, technical connection data). Legal basis: legitimate interest (Art. 6(1)(f)).
  • 🔹 Cookies and trackers that are not strictly necessary: only with the User's consent (Art. 6(1)(a)); see Article 10.
  • 🔹 Marketing communications or satisfaction surveys: only with the prior consent of the person concerned.

Exchanges via e-mail or instant messaging (for example e-mail or WhatsApp) that the Guest chooses to use are subject to the terms of those services.

The booking form offers an optional field “specific accessibility or health needs”. The Publisher does not require any health data, and leaving this field empty has no effect on how the request is handled. If the Guest chooses to fill it in, or to provide information of the same kind by any other means (for example an allergy, a health-related diet, a disability or reduced mobility), the Guest expressly consents, within the meaning of Article 9(2)(a) GDPR, to this information being processed by the Publisher solely to organise and adapt the stay, and shared only with the staff and providers strictly concerned. This consent is given by submitting the form and ticking the acceptance box; it may be withdrawn at any time under the conditions of Article 8.5, without affecting the lawfulness of prior processing. This information is deleted at the end of the retention period set out in Article 8.3.

The Publisher neither sells nor rents personal data and does not use it for purposes other than those indicated above.

8.3 Retention periods.
  • Quotation, booking or contact requests not followed up: 2 years from the last contact.
  • Guests, partners and hosts: for the duration of the relationship and then, for accounting records, for the statutory retention period (10 years).
  • Technical connection data: no more than one year, in accordance with the law, with the hosting provider.
  • Cookies subject to consent: 13 months maximum.

At the end of these periods, the data is deleted or anonymised.

8.4 Recipients and transfers outside the European Union.

The data is intended for the Publisher and its authorised staff, and for its strictly necessary processors (in particular the Site's hosting provider and the messaging services used). Information needed for an excursion (for example first name and number of participants) may be communicated to the provider concerned.

As the establishment is located in Senegal, the data may be accessed and processed from Senegal, a country that does not benefit from an adequacy decision of the European Commission. This transfer is necessary for the implementation of pre-contractual measures or for the performance of the contract concluded at the request of the data subject (Art. 49(1)(b) GDPR). Messaging service providers may also process data outside the European Union with the safeguards provided for by the GDPR.

The data is not passed on to any other third party, except where required by law or in the event of a takeover of the business, in which case the acquirer shall be bound by the same obligations.

8.5 Rights of individuals.

In accordance with the regulations, every person has the following rights:

  • right of access (Art. 15 GDPR), rectification (Art. 16) and erasure (Art. 17);
  • right to restriction of processing (Art. 18) and right to object (Art. 21);
  • right to portability of the data provided, where processing is based on consent or a contract (Art. 20);
  • right to withdraw consent at any time (Art. 7(3)), without affecting the lawfulness of prior processing;
  • right to set out instructions regarding the handling of their data after their death.

These rights may be exercised by e-mail to opapayer@gmail.com. The Publisher responds within one month (Art. 12(3) GDPR) and may request proof of identity where there is reasonable doubt as to the identity of the requester. Certain deletions may be refused where the law requires the data to be retained (accounting obligations, for example).

Any person may also lodge a complaint with the CNIL (https://www.cnil.fr/fr/plaintes).

9. Security and incident notification.

No method of transmission over the Internet or of electronic storage is completely secure, and the Publisher cannot guarantee absolute security. It implements reasonable technical and organisational measures (secure HTTPS connection, restricted access to data) to protect data against loss, misuse, unauthorised access, disclosure, alteration or destruction.

In the event of a data breach likely to result in a risk to individuals, the Publisher notifies it to the supervisory authority under the conditions of Article 33 of the GDPR and informs the data subjects where the risk is high (Art. 34).

10. Hyperlinks, cookies and tags.

The Site contains hyperlinks to other sites. The Publisher cannot verify the content of those sites and accepts no liability in this respect.

10.1 Cookies.

A “cookie” is a small file stored on the User's device (computer, smartphone) when consulting the Site. Cookies that are strictly necessary for the operation of the Site are placed without consent. Other cookies or trackers (for example those of third-party content embedded in the Site, such as videos, maps or social network buttons, where applicable) are placed only after the User's consent, obtained via the banner displayed on the first visit.

The User may accept, refuse or change their choices at any time, free of charge, via the banner or their browser settings. Refusing certain cookies may limit certain features of the Site. The Publisher disclaims all liability for any impaired operation of the Site resulting from this choice.

10.2 Tags and audience measurement.

The Site does not use Google Analytics. Should an audience measurement tool or tracking tag be added, it would be activated only with the User's consent, and these Terms of Use would be updated accordingly.

11. Applicable law, dispute resolution.

These Terms of Use are governed by French law, without prejudice to any mandatory protective provisions binding on the Publisher, in particular for consumers and for stays and activities performed in Senegal.

In the event of a dispute, the Guest is invited first to contact the Publisher at opapayer@gmail.com in order to seek an amicable solution. Failing this, the competent courts shall be determined in accordance with the ordinary rules of law; consumers retain the benefit of the rules of jurisdiction that mandatorily apply to them.

Should any provision of these Terms of Use be declared null and void or unenforceable, the remaining provisions shall remain in force. The Publisher's failure to rely on any provision shall not constitute a waiver of its right to rely on it.
